1. General provisions

1.1 Abitgames (defined below) owns and operates the Platform (defined below) and uses various tools and features to help sellers (defined below) display sales information for their various products (defined below) by establishing and operating seller stores (defined below) on the Platform.

1.2 Abitgames allows users to search and view the products offered by the sellers store.

1.3 Unless otherwise stated on the Platform, Abitgames is not the seller. Abitgames does not purchase goods from the seller or resell them to the buyer (as defined below).

1.4 Transactions within the sellers store are conducted only between the seller and the buyer, while Abitgames provides tools and technologies to host, set up and operate the sellers store, search and view the products offered by the sellers store, manage the goods purchased from the sellers store, and provide certain additional services designed to improve transaction security, speed and certainty.

1.5 These Terms and Conditions define the legal relationship between Abitgames and the User (as defined below).

1.6 These terms and conditions do not include payment services, including the initiation, transfer and/or receipt of payments related to transactions with the sellers store. Payment services are provided by the payment service provider in accordance with the terms and conditions separately agreed between the payment service provider and the user.

1.7 These terms and conditions do not determine any conditions of the transaction and contract between the buyer and the seller, including price, content, quality, safety, legality, warranties and liabilities.

2. Definition

Account ------ refers to the account opened by the user on the platform.
Adjustments ------ Refers to all refunds, cancellations, withdrawals, rejections, penalties, returns, adjustments, fees, surcharges, expenses, exchange fees and similar charges and assessments, as well as other amounts payable to the Seller and/or Abitgames for breach of these terms and conditions, regulations and any intermediary rules.
Related Party ------ refers to a company, partnership, or other entity that controls Abitgames, is controlled by Abitgames, or is jointly controlled with Abitgames. In this definition, "control" means directly or indirectly owning at least fifty percent (50%) of the voting rights in that entity (or equivalent rights for non-corporate entities).
Buyer ------ means a natural person and/or legal person who purchases goods from the sellers store.
Consumer ------ refers to any natural person whose conduct relating to Abitgames does not constitute trade, commerce, craftsmanship or occupation.
External Seller Warehouse ------ shall have the meaning given in Article 5.5.1 of this Agreement.
Export to external Seller Store ------ as defined in Section 5.5.1 (a) of this Agreement.
Fees ------ Fees, surcharges, expenses, exchange fees, similar fees and assessments and other payments payable by users for services provided by Abitgames Fees charged to users, particularly fees and commissions related to activities of sellers in seller stores.
Abitgames Balance ------ A technical service, including but not limited to storing data reflecting the users claim record (except for payment options outside the platform), and Abitgames is obligated to pay the user the claim in a reasonable and undisputed manner.
Abitgames Material ------ shall have the meaning given in Article 11.1.1 of this Agreement.
Abitgames ------ refers to one of the following companies providing services under these terms and conditions:
2.11.1 Abitgames Limited, registered office is located in Hong Kong, address: Room 31, Block 2, Times Square, 1 Massey Street, Causeway Bay, Hong Kong; Room 8, Phase II, Kaitai Factory Building, 99 Jingfu Street, New Pokhong, Hong Kong; Commercial Registration No.: 77970769;
Import of goods from an external sellers store ------ as defined in Article 5.5.1 (b) of this Agreement.
Intermediary institutions ------ refer to the institutions that participate in the payment and transfer between the buyer and the seller due to the transaction, especially banks, settlement agents, receiving institutions, payment system operating entities, card organizations, electronic money institutions, payment service providers or financial institutions.
Intermediate Agency Scheme Rules ------ means all existing and future statutes, rules, regulations, interpretations and other guidelines promulgated from time to time by any intermediate agency.
Compensation ------ shall have the meaning given in Article 12.4.1 of this Agreement.
Compensation Party ------ has the meaning given in Article 12.4.1 of this Agreement.
Project ------ means electronic tools, in particular game activation codes, gift cards and other types of vouchers and in-game items accounts and activation vouchers provided by the seller in its sellers store, which are entitled to receive products outside the platform by the person holding such tools.
Penalty ------ Any penalty and/or amount (including any related costs) imposed by a court, government agency or intermediary on the seller for breach of these Terms and Conditions, the rules and/or regulations of the intermediary.
Product ------ Average goods and/or services provided by a third party unrelated to Abitgames to the project holder outside the platform.
Privacy and Cookie Policy ------ refers to a set of rules implemented by Abitgames and its affiliates to regulate personal data processing and privacy protection policies. The Privacy and Cookie Policy can be found at: https://www.abitgame.com/privacy-policy.
Regulations ------ refers to any applicable laws, regulations, decrees, acts, provisions, orders, directives and guidelines issued by the relevant government agencies, regulatory agencies, self-regulatory agencies, trade associations or any other relevant trade and/or industry organizations applicable to users.
Sanctions ------ refers to any financial, economic or trade sanctions or restrictions imposed, implemented, imposed or enforced by the authorities of the Government of the Peoples Republic of China, including Hong Kong, the European Union, the United Nations Security Council, the Office of Foreign Assets Control (OFAC) of the United States Department of Treasury or the United States Department of State or any other competent authority.
Seller ------ refers to an entrepreneur operating in any form, including a sole proprietorship, corporation, partnership or other entity, operating the sellers store.
Seller Store ------ refers to a dedicated and independent space with a unique name and address operated by the seller within the platform. Abitgames provides tools and functions for the seller to host, create, modify and operate an online dedicated store within the platform.
Platform ------ refers to a cluster of associated websites provided in mobile applications available on the Internet under the Abitgames domain name.
Reflink ------ refers to a special website address generated by the platform-specific function, which contains the unique identification of the goods provided by the platform that can be viewed after the user clicks.
Reflinked Person ------ refers to the user who clicked on another users Reflink, so because of the click on the Reflink, there is a valid cookie in his network browser.
Services ------ refers to the services referred to in Article 5.1 of this Agreement.
Terms and Conditions ------ refers to these terms and conditions, including the annexes, which contain a set of rules governing the use of the Platform and the rights and obligations of users and Abitgames.
Transaction ------ A sale transaction between the buyer and the seller through the sellers store, whereby the buyer purchases goods from the seller.
User ------ refers to the seller, the buyer and/or any third party using the Services.

3. Applicability

3.1 These terms and conditions apply to the relationship between Abitgames and the User.

3.2 Abitgames does not set the terms and conditions between the Seller and the Buyer, including that Abitgames does not determine the terms and conditions of the transaction between the Seller and the Buyer.

3.3 Buyer-Identifies the relevant Abitgames company.

3.3.1 Subject to article 3.3.2 (Abitgames Plus), 5.4 (Newsletter), 5.9 (Abitgames Balance) and 5.10.8 (Goldmine), the Buyer enters into this clause and conditions with the following company at its place of residence, headquarters or habitual residence:

Abitgames Limited, registered address in Hong Kong, address: Room D07,8th Floor, Phase II, Kaitai Factory Building, 99 Jingfu Street, Sai Kung, Hong Kong.

3.3.2 As set out in Article 5.8, the Buyer enters into this clause and conditions with the following company based on the buyer's place of residence, head office or habitual residence:

3.4 Seller-Identify relevant Abitgames companies.

3.4.1 The seller enters into this clause and conditions with the following company, depending on the domicile, head office or habitual residence of the buyer and seller:

4. Platform, prohibited operation and placement location

4.1 Technical requirements.

4.1.1 The minimum technical requirements for using the platform are as follows:

  1. Email access;
  2. Electronic equipment with Internet access;
  3. Web browsers that support Cookies and JavaScript are enabled.
4.2 Prohibited acts.

4.2.1 Users shall not provide the following contents to the Platform:

  1. Causes work interference or overload of the Abitgames online system, including the platform;
  2. Violation of laws and/or this Agreement;
  3. Infringement of the rights of third parties, including copyright, intellectual property or personal rights;
  4. is other illegal content.

4.2.2 The User acknowledges and accepts that the openness of the Internet and the use of electronic services may pose risks, namely that unauthorized persons may obtain and modify user data, as well as "infect" online systems through various software primarily designed to cause damage, such as viruses, "worms" or "Trojans".

4.3 recommender system.

4.3.1 The platform allows default sorting of items and adjusts their placement order according to user behavior.

4.3.2 The quotation location recommended in the recommendation system is based on the mechanism that takes into account the following factors:

  1. In the search engine on the platform, the ranking of projects depends on the following factors:
    1. Pay-per-click promotion of offers for specific sellers (seller stores), enabling them to set their offer prices higher than those of other sellers (seller stores); pay-per-click promotion of offers for specific sellers (seller stores), enabling Abitgames to generate revenue and maximize the impact on the placement of listed offers;
    2. Data related to the product ------ the number of items purchased by buyers over time intervals, relevance scores of user queries, availability of the product, and regional parameters affecting its ability to be used by relevant users; the release date of the product; therefore, these products better align with individual user preferences; and
  2. In the quotation page related to the project:
    1. Provide paid promotions for quotes from specific sellers (seller stores), enabling them to set their product quotes higher than those of other sellers (seller stores); provide paid promotions for quotes from specific sellers (seller stores), allowing Abitgames to generate revenue and maximize the impact on the placement of listed quotes; and
    2. The price of the goods is the object of the offer, the number and proportion of positive and negative opinions about the seller (the sellers shop), and the method of delivery of the goods (immediate or deferred); therefore, goods offered by reputable sellers at lower prices and at higher prices than other sellers will be delivered;
  3. At the selected quotation site:
    1. The quantity of goods provided by the seller; the number and proportion of positive and negative opinions about the seller (the sellers store), as well as the impact of regional parameters of the goods on their ability to be used by relevant users; thus, these offers are more suitable for the individual preferences of users;

4.3.3 Within the platform, in addition to the default sorting according to the standards mentioned in Section 4.3.1 and Section 4.3.2, users can also choose the following types of item offering sorting:

  1. Price-starts from the lowest. It will be sorted in descending order according to the price of the items on the list; however, the paid offer will always be at the top of the sort;
  2. Best evaluation. It considers the following criteria in order of priority: availability of the item, and the number and proportion of positive and negative opinions about the seller (seller store).
